Types of Claims

Under the provisions of the Workers’ Compensation and Rehabilitation Act 2003, your employer is legally responsible for providing:

  • A safe, hazard-free workplace – office/factory/plant
  • Properly maintained plant, equipment and tools in full working order
  • A safe system of work which includes proper training of employees to use necessary equipment; enforcement of correct safety practices and employee notification of system changes.

If you are injured at work then you may have a claim. This can include injuries caused by:

  • The mistake of a co-worker
  • Inadequate instructions or supervision
  • Failure to warn of risks
  • Inadequate policies or procedures
  • Failure to properly coordinate trades on a construction site

Dependents of a worker may claim for loss of dependency if the accident results in a fatality.
